Eignungskriterien

• (on request only) Proof of the bidder’s incorporation and/or registration, as pre-scribes in ist country of origin, on one ofe the professional or trage registers or provison of a certirciate or an oath that is engaged in the profession in question in a specific place and a given business name.

• Proof that the tenderer holds valid professional indemnity insurance in line with market standards.

• • •(1) Declaration that no reasons for exclusion according to Sec.123, 124 GWB (Gesetz gegen Wettbewerbsbeschränkungen – German Federal Act against Restraints of Competition) exist. The bidder can use Appendix 3.
  • •(2) Self-declaration regarding the implementation of Article 5k(1) of Regulation (EU) No 833/2014, as amended by Article 1(15) of Council Regulation (EU) 2022/1269 of 21 July 2022 (‘Standard form on Russia sanctions’).

• (1) Only upon specific request by the contracting authority

  • •a certificate of good standing from the tax office. Foreign tenderers must submit an equivalent certifi-cate from their country of origin, accompanied by an officially certified transla-tion.
  • •(2) Only upon specific request by the contracting authority: proof that the tenderer has paid all statutory social security contributions in full. Foreign tenderers must submit a certificate from their country of origin, accompanied by an officially cer-tified translation.

• Details of references relating to legal advisory services. References must be submitted in the form of a self-declaration. A certificate from the client (letter of reference) is desirable but not a minimum requirement. The address and telephone number of the respective client(s) for the reference project must be provided, if legally possible. Minimum standards

  • •At least one reference comparable in nature of the work as described in the Service Description from the last five years must be provided for each of the following areas of expertise. The references must be relevant to the services specified in the tender.
  • •(1) Reference in Africa,
  • •(2) Reference in Asia,
  • •(3) Reference in Latin America.
  • •A single reference may meet several requirements at the same time. However, a total of three references must be provided.
